TERMS OF SERVICE
PREFACE
"I", along with any other first person pronouns refers to me as the supplier. "client" refers to the client using the commissioned service I provide. "both parties" refer to the both of us under our relation as supplier and client.By purchasing the services provided, the client states their agreement to the offered terms of service, thus abiding by the offered terms.
TERMS
The works that I provide are done under the assumption that the client has read and agreed to the offered terms, and I reserve my right to cancel or reject any service without refund IF there are any found and confirmed breaches of the offered terms.I also reserve my right to save and modify any assets created in the project files of the commissioned piece (samples, synth patches, and audio effect presets) for personal use and creative purposes, as well as for future commissions.Following the statement above, the client is also allowed to ask for the stems of the finished piece and hold the rights for said stem. Keep in mind that distributing, selling, and giving away said stems without permission are strictly forbidden.If you're a minor or don't have your own form of payment (purchasing my services through your parents or guardian), please confirm and consult your parents before making a purchase. I reserve my right to refuse said commission and will act according to the terms of refunding once the commission has been made.
PAYMENT
Payments are to be done upfront for the sake of the safety of both parties but can be done in 2 installments (paying half upfront and the rest after the piece is finished) if requested by the client. I'll be asking for your email for invoicing purposes.I am obliged to keep any of the client's personal information classified, and will not be using any of that information in any of our interactions unless necessary (e.g. confirmation), as well as outside of our interaction without permission.Payments are done via bank transfers or e-wallets locally and via PayPal internationally. Payments are done in USD except for local payments, which is paid in the conversion from USD, rounded up or down if necessary.Any fees taken from the transaction media used will be addressed to the client, and I will not ask for any addition or markup of the price to account for said fees.Tipping or any form of gratuity are welcome and appreciated, but not necessary.
REFUNDS
The client has the right to receive a full refund within the first 48 hours after a payment is made. once the project has started, the client will receive their refund following the conditions stated below:Once the base idea of the project is laid down, the client will receive a 70% refund.
When I determine that the project is half-done, the client will receive a 30% refund.
The client is not allowed to request a refund if the project has been finished.Keep in mind that the refund does not account for any admin fees that transaction media takes, and you lose your rights to the piece when a refund has been made,I have the right to use the project for personal purposes or resell the project file accordingly when a refund has been made.Any unjust attempts at refund without prior notice will be considered as unjust enrichment, and are subject to legal action.
CAPABILITIES AND SKILL
I will consult to the client about my capabilities and skills regarding what I will be working on. If I deem that the project that I will be working on is either beyond my capabilities, or go against my beliefs (e.g. any mentions of controversial topics like religion, politics, etc. or any form of hate speech), then I reserve my right to refuse said commission.
REFERENCES
I take references in the form of YouTube links, Discord audio files, and/or MIDI files, and will use the reference material as ideas for the project. I reserve my creative freedom to work on the project with my aspirations and ideas following the client's prompt unless the client asks to imitate a certain element, which I will try to recreate as best as I can.
TIMEFRAME
I will try my best to deliver the finished piece within a timeframe of 2 weeks - up to 6 months or more depending on the project. I will let the client know if I finish the project earlier or if I will be delivering the project later than the given timeframe. The timeframe will heavily differ depending on what kind of project I will be working on, but I will try my best to work on and deliver the project as soon as possible nevertheless.
